6. Intellectual Property

All content on the Site — including text, graphics, calculator code, logos, layouts, and the compilation thereof — is owned by Over40Macros or its licensors and is protected by copyright, trademark, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for personal, non-commercial use only. You must not:

• Copy, reproduce, modify, distribute, transmit, or publish any content from the Site without prior written permission;
• Scrape, harvest, or systematically extract data from the Site;
• Reverse engineer, decompile or attempt to extract the source code of the calculator;

• Damages from any interruption, defect, error, or delay in operation of the Site.

This limitation applies regardless of whether the alleged liability arises in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Where liability cannot be excluded by law, our total aggregate liability arising out of or relating to your use of the Site is limited to the greater of (a) AUD $50 or (b) the amount you have paid us in the 12 months preceding the event giving rise to the claim (which, for a free service, will typically be zero).

Australian Consumer Law notice: Where the Australian Consumer Law implies a guarantee that cannot be excluded, our liability for breach of such a guarantee is limited (where permitted) to supplying the service again or paying the cost of having the service supplied again.

11. Indemnification

You agree to indemnify, defend, and hold harmless Over40Macros, its operators, contributors, affiliates, agents, and licensors from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your violation of any rights of another party;
• Your violation of any applicable law or regulation;
• Your use of the calculator while falling within an Excluded User category set out in Section 4.

13. Termination

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of South Australia, Australia, without regard to its conflict of law principles.

You agree that any legal action, dispute, or claim arising out of or in connection with these Terms or your use of the Site shall be brought exclusively in the courts of South Australia, Australia, and you submit to the personal jurisdiction of such courts. You waive any objection based on inconvenient forum.

If you are accessing the Site from outside Australia, you do so on your own initiative and are responsible for compliance with any applicable local laws. Nothing in this clause limits any non-excludable rights you may have under the consumer protection laws of your country of residence.

15. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid provision shall be replaced by a valid one that most closely reflects the original intent.

No waiver of any provision of these Terms shall be deemed a waiver of any other provision or of such provision on any other occasion.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Over40Macros regarding your use of the Site and supersede all prior agreements and understandings.
